香川町男性刺殺、病院側争う姿勢／損賠訴訟（ウェブ魚拓いのげちゃんねる経由）
２００５年１２月、高松市香川町の駐車場で高知市の会社役員矢野真木人さん＝当時（２８）＝が刺殺された事件で、殺人罪などで服役中の男性受刑者（３９）の両親が、受刑者が事件を起こしたのは、当時入院していた高松市内の精神科病院が外出禁止など必要な措置を取らなかったためとして、運営する医療法人と主治医に慰謝料２０００万円の損害賠償を求めた訴訟の第１回口頭弁論が２日、高松地裁（吉田肇裁判長）であった。
この訴訟はパンドラの箱を開けてしまうかも知れないな、と思いました。
単に、医療側に対する影響だけにとどまらない問題をはらんでいます。
裁判所は重い問題を突きつけられたと思われますが、そういう自覚のある裁判官たちであってほしいと思います。
なお、入院患者は現在受刑者つまり有罪判決を受けていますので、刑事裁判では犯行当時心神喪失ではなかったと認定されていることがわかります。
つまり、自ら善悪を判断してその判断に従って自己の行動を制御する能力を失っていたわけではなかったという認定です。
素朴な疑問なのですが、刑事裁判の場合にも既判力みたいなもの(後訴に対する通用力)はあるのでしょうか？
つまり、前の事件での責任能力の認定が、この事件の裁判における犯罪の成立要件としての責任能力の認定に影響を与えるのか、ということです。
それとも検察側が証拠として提出するだけなのでしょうか？
私には、医学的な事は何も言えませんが、「障害者自立支援法」、「精神保健及び精神障害者福祉に関する法律」、「心神喪失等の状態で重大な他害行為を行った者の医療及び観察等に関する法律」、それぞれの法律の理念・目的（今現在の実情の事ではなく、法文として謳われた主旨です。）、そうして実務上の運用指針、それらに対する社会的通念。。。
これらの観点からは、今後の社会全体の進路の一つの分水嶺になる気がします。前記法令のみならず、世間（と言う空気）の今後の漠たる指針・指標として、非常に大きな意味を持つことになるだろうと想像致します。
原告のお立場に鑑みると場合によっては、社会からの隔離・隔絶ではなく社会復帰や更正を第一義とする、そうした（広義での）刑法典全体の有り様の問題にも波及する可能性が否定できないほどに、社会全体としての重さを内包する訴訟なのだろうと感じます。
杞憂に終わればよいのですが、単に精神医学又は医師若しくは医療体制の問題のみならず、そうした社会的な観点からも、今後の展開からは目を離せない訴訟だろうと思います。
まとまりのない投稿で恐縮ながら、第一印象としては、そのような事を考えずには居られませんでした。m(__)m
刑事裁判の既判力は、民事裁判には及びません。
ただし、事実上の影響はあると思います。
河原美代子を弁護した弁護士は力がなかったんでしょうか？
執行猶予をつけられなかったどころか、懲役１年８ヶ月という非常に重い実刑まで負わされましたよね。
河原氏は、この自称被害者夫婦からひどいいじめを受けていたと証言していましたが、弁護士らはそれを立証することも出来ず、完全に加害者・検察側に負けてしまったのでしょうか？
この弁護士の名前を調べることは出来ますか？
この種の殺人既遂事件は、量刑調査を見ればわかるとおり、執行猶予はありません。被告人の主張が妄想だった可能性が高いです。その点は、被告人の責任能力や量刑に関して重要な事実ですから、検察側が当事者の供述だけではなくて、客観証拠でも積極的に立証しているのが通例です。
御参考まで。

まず一点目。
こういうケースの場合は、原告も鑑定人を立てて『当時入院していた高松市内の精神科病院が外出禁止など必要な措置を』取る必要性があったことを立証する必要があり、被告と医学的な観点から争うことになるのでしょうか？それとも、被告が『当時入院していた高松市内の精神科病院が外出禁止など必要な措置』が無かった事を立証できなければそれで負け、となるのでしょうか？
私は精神科には全く疎いのですが、単純に原告側鑑定人となってくれる医師が居るとも思えないんですよね・・・。
次に二点目です。
この主張が認められるという事は、非常に被害者意識を強く持ってうがった見方をすれば、この被告病院の主治医は、最終的には業務上過失致死に抵触する可能性もあるし、殺人被害者の遺族からも損害賠償請求される可能性もあるという事だと思います。医療側からすれば受け入れがたい事態だと思います。
その点に関して、医療関係者以外の方も共感していただけるでしょうか？それとも、『医学的判断が間違っていたとしたら仕方が無いんじゃない？』というのが普通の感覚なのでしょうか？
最近は、この辺の問題に対する自分自身の感覚に自信がなくなってきています。。。

非法曹＆被医療者である私の第一印象程度のお話で宜しければ。
一点目の話は、
申し訳ありませんが、私は応答する術がありません。
二点目の話は、
１）法律上の理屈は判りかねますが、主治医の先生が直接被害者に危害を及ぼして死に至らしめた訳ではないので、業務上過失致死の罪に問うのは余りにも無茶な話ではないかと感じます。
２）理屈の上では、被害者遺族から主治医が民事で損害賠償を求められる可能性はあると感じます。また、仮に今回の訴えが認められるなら、被害者遺族も尚更のこと主治医や病院に対して、心中穏やかでないかも知れませんし。
一方で、この問題は当事者の人権の尊重と社会防衛の観点から非常に難しい判断を迫られる面があると思います。また精神科領域の特性（物理的・外形的・他覚的に明確に判断が難しい。）もあるでしょうし、身体拘束等の手段を用いる事への問題もあったりして、医師や医療機関の責任を問うのは酷な話だと思います。（院内で暴れていたりする等明らかに問題行動が行われているのに、何らの措置をしなかったという話なら評価も変わり得ると思いますけど。そのような前提をおいてのお問いかけではないと思っています。）
以上、あくまでも個人的な印象であって、必ずしも法律上の正当性が保障されるものではありませんので、何のお役にも立てないかもしれませんが、私の感性に従えば上記の様に思えます。m(__)m

大変参考になりました。というのも、法曹関係者の方のご意見は非常に重要ですが、それ以上に大切なのは、非医師・非法曹関係者の感覚だと思うからです。
仰っている事、私の感じている事と全く同じであります。
おそらくは、それが国民感情のスタンダードなのかなぁと思っております。
医療訴訟の判決にしか親和性がないもので、原告の訴訟物に違和感を感じます。
一家の支柱でない人の死亡に伴う慰謝料２０００万円だけの要求ということは、生涯賃金の逸失利益を損害として賠償要求していないと読めます。
過失責任がなければ慰謝料も発生しないし、過失責任があるのなら逸失利益も含めた賠償請求もしそうなものなのだけれど、何か理由があるのかな？という感想です。
ここで医療側の責任があるかのごとく判定されたら、社会復帰を目指す精神障害者の人には厳しい世の中になってしまうことでしょう。
過失認定されたら、次の訴訟の訴訟物は交通事故並にはなることでしょう。

恐縮ながら、私見を申し述べさせていただきます。ペコリ。
この訴訟は、「医療機関等の過誤がなければ、自分の子供が加害者（殺人犯）になることは無かった」という認識の下で、加害者親族が医療機関等を訴えている構図なのだから、請求されているのは「加害者になってしまったことの慰謝料」であって「死亡に伴う慰謝料」ではないのだろうと思います。
従って、原告（加害者親族）として、死亡者の生涯賃金などの遺失利益を訴えようにも、そもそもそうした遺失利益は存在しない、加害側なのだから。と言うことで、違和感は感じないのですが。。。論法を間違えているのかしら？わたくしは。
もっともリンク先の記事によれば、被害者遺族も病院の監督責任を訴えて係争中で、裁判所が両事件を併合したようですけれど、慰謝料２０００万円の件はあくまでも加害者親族側の訴えだと、記事を読んだのです。
こちらのサイトに、被害者のご両親の主張されている内容が詳しく掲載されています。
その中の、「いわき病院を被告とする民事訴訟趣意書」で請求額に関する説明がなされていました。
かなりの分量の文章ですので、私も全部を読んだわけではありませんが、、、。ご参考になれば幸いです。

被害者遺族の病院に対する提訴が、加害者親族の病院に対する提訴より、時期的には先行しているように思えました。
文中に少しだけ触れられている部分によれば請求額も「億円」の単位ですし、被害者遺族の提起した訴訟では、遺失利益の賠償も求めて居られるように思えました。
当事者の一方だけの見解であることに留意は必要と思いますが、「医師や病院の責任について」と言うより、「精神科医療に対して社会的に期待されているもの と 現実の精神科医療が提供できる医療水準＆背景にあるヒト・モノ・カネの問題 との間のギャップの大きさ」を考えずには居られないです。
被害者遺族と加害者親族の両方から病院が訴えられる状況・・・、難しいです。
加害者側が殺人犯になったことをもって第３者に対し裁判起こすって「盗人たけだけしい」とは思いませんか。こんなものが認容されたら法も秩序もめちゃくちゃです。
あくまでも法律のトーシローの考えと思し召し下さいね。
被害者ご家族の言い分に納得してしまいます。無期懲役を減刑する理由として、精神疾患が挙げられているのなら、そして、入院中だったというのならなんでというのは当然の気持ちでしょう。
ただ、精神科ではないので、そして、精神科のことは理解しがたいので、専門の先生のコメントが知りたいのですが、自傷他害の恐れというのは、本当のところどの程度予測可能なんでしょうか？
精神科のクリニックで、精神安定剤を山ほどもらって、それを一気に飲んで救急病院に何度も運ばれてくる、あるいは、何度もリストカットをはかって運ばれてくる患者さんがいますが、かかりつけの精神科の先生たちは、だから〜？という反応が多いです。つまり、自傷行為ですら、精神科の医師であっても予測不可能なことなのではないでしょうか？
自傷他害の恐れがあるかどうかの判断ができないものだとしたら、殺人に対する責任能力がないと判断される患者を隔離しないで、退院させることは、誰のためなのでしょうか？
精神保健福祉法で定める「自傷他害のおそれ」は、軽微な自傷行為等は含まず、「自殺、殺人、放火、凶器を使った加害など重大なものであって、かつ、それを惹起する高度の危険性を有する精神疾患若しくは精神障害状態を言う」、という取扱いが多いようです。ソースは出せませんが。
私はてっきり、このエントリーで話題になっている話は、被害者のご両親が訴えを起こされた話だと勘違いしておりました。加害者のご両親だったのですね。モトケン先生がパンドラの箱と表現された意味が少し分かった様な気がします。全くお恥ずかしい限りです。

おっしゃる通りだと思います。ただ、「精神科医療に対して社会的に期待されているもの」この辺が難し所かもしれません。おそらく医療そのものの質的な問題をご指摘のことと思いますが、「社会防衛的な役割の一部を精神科医療は担っている、担うべきである」という考え方もあるかと思います。おそらく精神科医の中でも意見が割れると思うのですが、thx-1138様にというわけではないのですが、皆様はどのようにお考えでしょうか？
精神障害者を隔離せよ！確実に監視しろ！という誤った考えに基づいた訴訟でないことを願います。
１ 一点目について若干てけとーに(スマソ)
というご質問に対する回答は｢立証は不要｣ということになるかと思います。この訴訟の詳細は不明なのですがおそらく不法行為に基づく損害賠償を請求しているものであろう、と想像されます。
それを前提にしますと、理論的には原告(加害者親族)が｢過失｣や｢因果関係｣を立証しなければなりません。
今回の訴訟では｢当時入院していた高松市内の精神科病院が外出禁止など必要な措置を取るべきであったのにそのような措置を取らなかった、という過失｣と｢そのような措置を取らなかったことと殺人事件の間の因果関係｣を原告は主張･立証しなければならないことになると思われます。
ただし、すでに平成18年に被害者遺族が訴訟を提起してからすでに約2年半が経過しており、この訴訟に今回の新たな訴訟が併合されています。被害者遺族も同様に｢過失｣と｢因果関係｣を立証しなければならず、mm3 さんご紹介のサイトを見る限り被害者遺族の方たちは熱心に訴訟活動をしていらっしゃるご様子ですから、被害者遺族の方たちの立証に加害者親族がタダ乗りするのが実際のところではないか、と予想します。
以上を前提にすると
ただし、被害者遺族や加害者親族が立証に成功しそうであるならば、立証の成功を妨げるために原告も鑑定人を立てるなどして適宜反論はしなければなりませんし、普通はそうすると思います。
なお、これも詳細は分かりませんが、おそらく医学的な観点から争うことになるかと思われます。そこらへんは原告の主張しだいですかね。
と、いうわけで
こういうことはありません。
２ 二点目について
通常の感覚では｢ありえねーだろ｣ということになろうかと思います。病院内で｢殺、殺｣などとわめきながら刃物をしょっちゅう振り回してる患者でなければ、ですけど。３ この裁判について
という部分は理解できます。｢素人の裁判官が｣という批判はあるだろうけど｢この場合はおｋ、この場合はアウト｣という線引きについての裁判所の考え方を明確にすることにはそれなりに意味はあると思います。被害者遺族の提訴はまだ分からんでもないです。
同意できない部分も多々ありますが
でも加害者親族の提訴の目的が分からない。｢条件の明確化｣という目的は加害者親族にはないと思うのですけど･･･。病院の判断が間違っていたのならある意味では被害者なのでしょうけどなんか共感できんなー
遺族には同情しますけど、心神喪失を認められない程度に回復している患者を閉じこめておく機能は精神科病院にはないんですよね。普通。保安処分でもあるまいし。

まず、私の筆力不足が原因で、この様な抽象的な申し上げ方しか出来なかった事をお詫び申し上げます。上手く伝わるか自信はないのですが、如何に文意の捕捉を試みます。
この表現で私が意図した事は、単に「精神医学の水準」や「精神医療の供給体制」というだけでなく、医学の水準・医療の水準という通常の医療機関に求められる事に加えて、「社会防衛機能を確実に果たしつつ人権擁護も確実に行う」というような、単に医療・医学に止まらない社会的要請とか社会政策上の要請に応える事を求められているという特性も含めてという意味でご理解いただけると嬉しい限りです。
そうして「人の心の動き」という、完全に判っておらず可視化することも出来ない非常に困難な領域である事に加えて、過剰に過ぎず不足に過ぎない加療によって安全・円滑な社会復帰を求めるという、理想としては高邁ながらも時として矛盾する命題に向かわなければいけないという困難性も含めた意味を、含む言葉として使いました。
加えて、精神医療についての敷居が低くなり、診療所の開業は増加傾向である一方、病院（病棟と言った方が良いのでしょうか。）の体制は非常に深刻な状況にあるという様な事も耳に致したりしておりますので、私自身のそうした諸々の現状認識を踏まえてのものとお考えいただければ幸いです。

「精神保健及び精神障害者福祉に関する法律」の規定に基づいて、任意・措置・応急の別を問わず入院の要不要を決める判定の基準としては、おそらく以下の告示によるものと記憶しております。十分にご承知の事とは思いますが、ご紹介申し上げるとするなら。
『精神保健及び精神障害者福祉に関する法律第二十八条の二の規定に基づき厚生労働大臣の定める基準（昭和６３年４月８日厚生省告示第１２５号）』※告示の形式としては厚生省告示ですが、厚生労働省告示として現時点に於いても有効です。
告示の内容としては、病状又は状態によってそれぞれ詳細があるものの、原則をかなり大雑把に申し上げれば、以下のように規定されている筈だろうと。
自傷行為：自殺企図等、自己の生命、身体を害する行為
他害行為：他の者の生命、身体、貞操、名誉、財産等又は社会的法益等に害を及ぼす、原則として刑罰法令に触れる程度の行為

軽犯罪法違反や道路交通法違反や「ぐ条例」違反も刑罰法令に触れる行為ですが，これじゃあ広過ぎますので。

この告示は措置入院の基準のみを定めたものです。
任意入院については文字通り患者の任意性に依拠し、医療保護入院については
単に精神保健指定医が「必要と認め」るか否かとしか規定がありません。
この受刑者がどんな入院形態であったかは書いてありませんが、外出を繰り返していたのだから措置入院はあり得ません。
もし任意入院であったのならば、病院には「日中原則として自由に外出できる」環境を与えることが法で義務づけられています。
病院側の責任・過失を認定するロジックを組み上げることは可能だとは思いますが、これ無理筋のような気がすごくするんですが・・・
事件の構図を一般化し敷衍していくと、例えば仮出所中の人物が事件を起こした場合に当該人物の仮出所を認めた司つかさに民事上の責任が問える、だとか、極論をしてしまえば「俺がこんな犯罪に手を染めたのは親が俺を生んだからだ」みたいな論法までも容認せざるを得なくなってくるんじゃないですかねえ。

法律の条文を通読いたしましたら、ご指摘の通りと申し上げるほかなく、謹んでお詫び申し上げます。
実は以前、結果として如何なる形態になるかは別として、入院を依頼する紹介状を書く上では、目の前の患者さんに対して、やはり一つのガイドラインとして念頭に置いて対応するという主旨の事を、伺った事がありました。
もちろんのこと、如何に本人が自発的に申し出たとは言え、不必要に病棟に送り込むことが正しいとは思わないという主旨であって、必要があれば躊躇はしないとも同時に仰ってました。
そのような訳で、措置入院という強制的措置をとる上での基準であることは間違いないものの、一つの判断基準として使われてるのかなぁ？等と、誤って早とちりして解釈してしまった様です。（恥
なお、本件事案に於いて、措置入院中であってか、任意入院中であったか、或いは入院の処遇の基準に照らしてどうであったか？という個別の事案・出来事についてあれこれ申し上げるつもりは毛頭ありませんでしたので、併せて申し述べさせていただきたく存じます。
結局の処、事案を限定しない抽象的な一般論としてという意味で申し上げたと言うことで、本件事案について門外漢である私が、関係者の方々にあれこれ申し述べるつもりは毛頭無く、その資格もないと思っております。

ご指摘の通知については、刊行されている当該法律の通知集、逐条解説本、詳解本など諸々の資料を拝読して、一応の運用の指針と申しますか理念と申しますか、法規の背景にあるものを調べて参りました。
例えば交通犯則事件であっても軽犯罪法違反であっても、一見軽微な違反行為であっても重篤な精神の変調に由来するのであれば、早急な対応が要求されると言う点や、事象を前にして過剰に過ぎず不足に過ぎない対応を求められるという点に於いて、命題として非常に難しいという感想を改めて思いました。
指定医の先生、現場のスタッフのみな様のような医療関係者のみならず、関係する行政関係者の方々に対して、尊敬と感謝の念を抱かずには居られないです。

一方で一般的な抽象論として、適正な処遇につなげて行くには、場合によっては一部の行政関係者（福祉関係或いは警察関係）や社会福祉団体関係者の役割も重要かな？と思ったりもしておりまして。一連のプロセスの起点としてという意味で。もちろん、一番大変なのは最終的に受け皿となる医療機関関係者である事は間違いないと思います。
ん～、先刻のコメントは、語彙の選択や文章の構成が拙かったかも知れません。。。
仕事柄、ＩＣＤ－１０もＤＳＭⅢＲ～Ⅳまで目を通した時期がありましたが、標準的で客観的な診察基準を定めても、最後は、Ｐ科の臨床経験に基づく医的判断が肝要だと思います。
多数の患者さんに接すると、多くの文献で繰り返し指摘されてきた事実上の鑑別直観「分裂病くささ（現・統合失調症くささ）」を素人の私でも感じることがありました。といっても所詮は素人判断に過ぎませんが。(^^ゞポリポリ
ある地方で、殺人事件を起こした方の最初の簡易診断が、「犯行状況を理路整然と述べるなど記銘力に問題がない」ので「うつ病の疑い」でしたが、検察庁が令状で鑑定留置の上で正式鑑定すると、鑑定医の先生が日記の微妙な表現を解読して「造語」とわかり、問診すると「調書の犯行状況は、刑事さんの横にＴＶがあってそこに移る犯人の映像のとおり、事件の様子を話しただけだ」と出て、社会適応が進んだ末期の統合失調症とわかり、殺意もＸＸの指示にしたがった妄想によるものと断定されました。
もちろん不起訴処分・措置入院手続きの要請となりましたが、受入側の事務屋は、月末の週末だったので、その手続きの各方面への手配でドタバタしたことで特に印象に残りました。ことほど左様、医学素人の事務屋の目から見ても、Ｐ科の診断・鑑別は本当に難しい大変なお仕事と思います。いわんや自傷他害の恐れにいたっては（以下略。

浅く考えると、ろくろくび様の言われるとおり、

のはずなのですが、被害者遺族のHPのあまりの凄さについつい「うーん、そうかも？」と思ってしまいそうでした。
通常、医療過誤は死亡なり心身の恒久的被害がなければ、訴訟になんかならないはずですが（なっても原告が負けるはず）、通常なら大した健康被害にならないはずの「医療過誤」が、これは殺人という重大な結果の原因になっている、という「医療過誤訴訟」だと原告（遺族被害者）は、言ってるんですね。
直感的には「無理筋」だと思うのですが、HPの情報だけですと被告（病院側）の対応がお粗末で、負けるはずのない訴訟でも負けてしまうことはあるかも、と思ってしまいました。
今後の展開の気になる訴訟です。
外出管理の点だけでは、殺人の責任まで被せられるはずはないと思いますが、医療過誤が原因と認められると、刑事の方まで引っくり返る可能性もあるかと思いますが、法務関係の皆様、どう思われます？

お恥ずかしい限りです。
それにしても、直接の加害者の関係者と、直接の被害者関係者の利害が一致したら、間接的加害者と目される病院の防御は大変そうに思えます。
やるせない気分になります
多分に私情が入っていますが(謎)、病院は障害者を隔離して絶対的に管理するところではありません。ご遺族や犯人の親族が錯乱状態や責任回避に走る心情は…類似例をこの眼で目の当たりに何度も見ているので…責める心情には毛頭ありませんが、それでも、病院の公的機能は、隔離と管理ではありません。治療がメインでそれ以外は副次的か反射効（損害賠償の対象外）に過ぎません。
現在の医療リソースの現状からすれば、税金がタップリ投入された医療観察法指定病院のような機能を一般病院に求めるのは、不可能を強いるものでしかありません。もちろん、「もしあのときこうすれば（こうだったら）」という「タラレバ」の気持ちで救いを求める関係者の心情は無理からぬものと知っていますが、それでも考えて欲しいです。m(_ _)m

それ故に、この判決を契機として、「病院ではない何か。という性格を有する施設機関」という方向に、行き過ぎはしないか懸念してもおります。
私は、どちらの訴訟も、反射効論（患者保護・管理は、医療契約当事者である患者と家族への義務で対世効を有する義務ではない）で請求棄却になると確信していますが、ご指摘の「施設機関」へ論点や責任追及が行くことに懸念を感じます。日本で「夜と霧作戦」が発動されることは命をかけても阻止したいので。
業界では有名な、指定医講習会では必ず言及されるＭ蔵野病院事件というのがあります。
要は無断離院した患者さんが見ず知らずの人を刺して、病院が民事的責任を取らされた事件。
幸い「患者の外出が出来ないようにするべきだった」という原告の主張はしりぞけられました。
でも一審は病院敗訴（警察への通報の仕方がよくなかったよね）。二審は通報の仕方は悪くなかったけど、まあ可哀相だからお金払いなさいよという流れで和解となりました。
民事専門外の私が紹介するのは僭越だと思いましたが、一定の条件下で病院（公立病院なら都道府県知事）の民事責任を認めるのが民事判例の傾向のようです。事実関係で左右される判例ですから、ぜひ、原典や解説に当たってください。

民事裁判で提出された証拠が、刑事手続きでも原判決と比較して「新規」かつ「明白」なる証拠であるかどうかです。民事裁判の判断そのものは「評価」であって「証拠」とはならないと思います（刑訴法４３５条６号）。

最近このブログで勉強させてもらっております。
この訴訟は、医師は改めて非常に難しい判断を迫られていると思います。
このようなケースは医療訴訟に限らず、同様の事例は司法判断に対してもおこり得るのではないでしょうか。例えば、一回目の殺人罪で服役した方が出所して、その後2回目の殺人を犯したとします。この時点で、犯罪者の家族や遺族から「一回目の犯罪に対する刑罰が十分であったのか」あるいは「量刑通りであったとしても反省してない犯罪所を出所させた」という観点より責任を追及されかねないかと思います。
つまりライセンスを与えられたものが高度な判断を下したとしても、不幸な結果を招いた場合は常に不適切な判断であったとして責任を問われかねないのではないでしょうか。
コーヒーブレイクとして聞いてください。
著名な教育法裁判で「大学受験に落ちたのは高校教師の教え方が下手だったから損害賠償しろ」という請求がありました。当然ながら請求棄却でした。
米国では、もっと先進的？で「自分が非行に走ったのは親の教育が不十分だったから」と両親に数十万ドルの請求をした民事訴訟がありました。
どちらも「憤慨した被告」が敢闘したことは言うまでもありません。

お言葉ですが、それはちょっとバイアスが強すぎる見解と思います。「netのお医者様症候群」に罹られているのではないですか？
「一回目の犯罪に対する刑罰」は、法の定める範囲であれば、それは裁判官の裁量です。
「反省してない犯罪所を出所させた」は、出所させなくてはいけないという法理はあっても、出所させてはいけないという法理はありません。
（明白に再犯の意図を表明していれば、予防拘束の責任は問えると思います。反省してない、では駄目です。）
それに対して本件は、真実が那辺にあるかは別として、被害者遺族の主張は相当の医療を施されず、用法から外れた投薬（と投薬中止）を行い、むしろ（結果として）攻撃性を増大させ、かつ、その重大な副作用を見逃すという医療過誤（過誤の本質は「用法から外れた投薬（と投薬中止）」と「必要な診察の放棄」、「重大な副作用の見逃し」です。）の責任を問うものです。
今時は有り得ない喩えだとは思いますが、このような場合はどう思われますか？
ある医院が仕事で疲れて心身の愁訴を訴える患者に、「寝る前に飲んでください。」とだけ伝えて、トランキライザーを院内処方したとします。
寝る前に飲んだ患者は、床に就く前にたまたま所用を思い出し、車で１５分程度のところに外出したとします。
運の悪いことに途中で強烈な眠気に襲われ、ついつい居眠り運転でハンドル操作を誤って死亡交通事故の加害者になってしまったとします。
さて、事故の被害者遺族は処方した医院に損害賠償を求める権利はないのでしょうか？
さて、十分な情報をみていないので（申し訳ないです、元ネタ大きすぎm(__)m）自信をもって言う訳ではありませんが、原告主張に納得がいかない点もあります。
単一の訴訟でみれば、どちらもわからないでもないのですが、刑事と民事ではダブルスタンダードではないかと感じます。
さらには、刑事と民事の病院の矛盾を責める点についてはブーメラン攻撃。
刑事の詳細情報知らないのでわからないのですが、どうも、レキソタンの奇異反応による責任能力の減殺弁護はないと思います。
もちろん被害者家族も厳罰主張で「レキソタンの奇異反応」なんか一言もありません。
では仮に「レキソタンの奇異反応」が真実であった場合、懲役２５年はあまりに重い刑罰ではないでしょうか？
刑事はすでに確定しています。「レキソタンの奇異反応」が真実であっても、しかし現状では誰も再審を訴えはしないでしょう。
正義の在り処の難しさを考えさせられます。
『仕事で疲れて心身の愁訴を訴える患者』が運転すること自体が、本人の過失に思えます。
過労運転は道交法66条違反(同罰則 第117条の２の２ ３年以下の懲役又は50万円以下の罰金)です。
眠くなることを求めて睡眠薬を服用しているという自覚もあるのですから、全くの本人責任で、医師・病院との関係は切れていると思います。
普通の人ならばしないことを期待して処方するのは当然のことであり、医師の責任は尽くしてます。
もし、メジャー・トランキライザーを処方していたら処方の誤りの責任は及ぶかもしれませんが、ベンゾジアゼピン系のマイナー・トランキライザー以外の睡眠薬を処方すること以外を想定すること自体がまず考えにくいです。
睡眠薬としてメジャーを使う可能性はあっても、蓋然性には乏しいです
被害者・遺族は、運転者に責任を求める他はないだろうと思います。
判例百選がやっと届いたので目を通してみました。
これ北陽病院事件ですね。これなら知ってます。指定医講習会では必ず勉強する事件ですよね。
間抜けな医者が措置入院中の患者さんを院外作業に出して逃げられて、人が殺された事件です。
措置入院させてたってことは、自傷他害のおそれアリと医者が認めてたんですから逃げられちゃまずいですよね。病院の責任は当然でしょう。
まあこのころは「経済措置」で入ってる人もいたからぬるい認識しかなかったんでしょうが。
北陽事件とこの事件と（とか武蔵N病院事件）とはちょっと比較にはならないと思いますよ。

ご指摘の点はそのとおりで、だから、こういう限界事例の判例は、「事実関係で左右される判例ですから、ぜひ、原典や解説に当たってください。」（No.38）というのは、事案ごとに（症例ごとのように）類型化して判断して判例の射程距離を見ないと、ひとつふたつの判例で判断するのは危険なわけです。
対査して、小論点や具体的事実関係の項目を縦軸・判例を横軸において、同一点、類似点、相反点の一覧表を作って判例の射程距離を探るのが効率的いいですよ。

なるほど、似たような症例を集めて、検討するのに似てますね。
と言いたいところですが、症例を検討するというのはあくまでその背後に何らかの自然法則がある、という前提なんです。
病気というのは自然科学の法則に従うものだから（かなりパラメーターの多いモデルですが）。
一方判決というのは、その背後に何か法則があるようで、結局のところ人の作為なんですよね。
法律の理路に則った判決ばかりではなくて、どんなに筋道を立てて考えても、お馬鹿な裁判官が「これでよかんべ」と決めたらそうなっちゃう、という。
その辺がむなしい感じがします。
馬鹿な裁判官を除外して、背後の法理論や証拠法則から射程距離を導き出しましょう。わかりやすい例では、「この犬が人に噛みつく予見可能性があるか」という命題では、「一噛み原則」というのがあります。これは、いままで一度も人を噛んだことがない犬が噛みつく予見可能性は厳密な立証を要するが、過去に一度でも人に噛みついた犬であれば過去に一度噛みついたことさえ立証できれば有過失（予見可能性）の立証が十分だ、とするものです。過去に一度でも脱柵した豚牛馬羊の管理責任の事例としても引用されています（英米法の古典的法理です）。
学者先生でこの対差手法を厳密にされた方がいます。それは、故・鈴木禄弥先生（東北大学教授、東海大学客員名誉教授）で、記録に残る日本の借地借家法の判例を全部対査して、事案ごとに類型化して分類したもので、判例がないものは判例の射程距離から結論を類推した大著かつ名著です（借地・借家法の研究(1984年))。
米国ブランダイス最高裁判事が弁護士時代に著わした社会学的準備書面「ブランダイス・ブリーフ」も切り口が異なりますが類似のアプローチをとられています。

私の挙げた例からですと、100％それは通らないだろうと思います。本人は心身の疲れと愁訴を訴えてだけで、睡眠剤を処方してくれるよう依頼したわけではありません。
薬理作用の説明に手落ちがあるのですから、医師・病院も責任は免れないでしょう。（本人が免責されるかどうかは話題にしていません。）

そのような理由で、処方の際必要な注意事項の伝達をおろそかにしておいて、｢責任を尽くしている」と強弁して通用するとは思えません。

即刻お考えをお改めくださいますよう。現在社会ではMed_Law様の感覚では全く通用しないと思われます。もし、正当性を争う事態が生ずれば、そのようなお考えで行動なさっていれば、必ず負けるでしょう。
