私の中では、大野事件での検察・警察を非難する事と、他の件で警察を頼りにしている事とは、別の次元の事だと思っています。医療事故で医療不信に陥っても、他の件で他の医師にかかった場合には、その医師に身を預けるのと同じ感覚です。
明らかにいい加減な酷い医師の過失で被害を被った患者さんでも、おそらくは大多数の医師がきちんと研鑽を積み真面目に医療を行い、信用に足る存在であることは、理解している事と思います。医師全てが酷い存在だとは考えていないと思います。
また我々も、例え相手がクレーマーであっても医学的に適正な診療を心がけておりますし、信用していただけるよう最善の努力を行います。それがプロだと思うからです。

私は、大野事件は単なる冤罪事件だと捉えております。それ以上でもそれ以下でも無いと。冤罪を生んだ背景には様々な要素があるので検察・警察だけを責めるつもりは毛頭ありませんが、冤罪を生んでしまった事に対しては、真摯に反省すべきだと思いますし、Ｋ医師に対しては、裁判に費やした期間の経済的損出をきちんと国が補償すべきだとも思っています。

Ｋ医師と同じフィールドに居るものとして、大野事件に関与した検察・警察関係者には猛省を促したいですし、

の「未だに」というフレーズには違和感を感じずには居られません。というのも、私の耳には、大野事件に対する検察・警察の総括が入ってこないからです。

ただし、繰り返しになりますが、検察・警察だけを非難するつもりは毛頭ありません。
医学的に誤った鑑定を行った鑑定人医師の存在も大きい（割には、学会などで公的に鑑定人に対するコメントを耳にした事はありませんが）ですし、そもそも、逮捕という手段を行わなければこの類の医療事故は正当に裁けないと検察に判断させた我々医療界の自浄作用に対する社会的信用にも大きな問題があるわけですし。医療界も、大野事件を生んでしまった背景を自己反省し、改善すべきは改善すべきだと思いますが、こちらもあまり目に見える動きは見えません。

　罵詈雑言をあびせ続けた程度とは、申しませんが、殴るけるといったことをしないでも、実刑になるものなのでしょうか？
　私の知り合いが、患者さんに、対応が生意気ということで、殴られたことがありますが、結局、大した罪にもならないからと、警察で言われ、裁判にすらできなかったことがあり、次に殴られたら、殴り返してやると怒っていたことを思い出しました。

　モトケン先生がトピックで明記されているように、前科の有無で実刑になるかどうか決まる場合があります。
　判決時に５年以内に実刑の執行を受け終わった（刑務所から満期出所日又は仮釈放期間満了日）被告人なら、累犯前科といって、法律上は執行猶予を付けたくても必ず実刑にするほかはありません。
　また、前刑の執行猶予中の犯行であれば、情状が特別に酌量すべき事情がないと、やはり実刑となります（執行猶予のダブルはマレのマレということです。）。
　このように、犯行態様や被害結果だけで、実刑かどうかと判断できないものであることをご理解ください。m(_ _)m

患者さんに、対応が生意気ということで、殴られたことがあります

こういう時こそ、診断書の威力を発揮するべきです。
カルテを作成し、写真を撮り、関係者の証言を記載して、証明書を作成すれば、立派な傷害罪の証拠になります

傷害の証拠と、弁護士の協力があって、警察が捜査・送検しないことはないでしょう。
弁護士費用を払いたくないくらいの処罰感情なら、忘れてしまうべきだろうと思います。

もちろん微罪をどこまで捜査するかは、忙しい警察にとっても、コンビニ医療と同じことになりかねないので大変でしょうが、大事なことは、「処罰感情」と客観証拠だろうと思います。
最近の警察は、事件を握りつぶすことの批判には耐えられないだろうと思います。

次に殴られたら、殴り返してやると怒っていたことを思い出しました。

これは最悪なので考えを改めてもらうようお願いします。
日本中のマスコミが面白おかしく報道し、医師生命も絶たれる可能性があります。
自身の立場を弁えて、暴力に暴力で自力救済なんか考えずに、知的に追い込むべきだろうと思います。
侵害を契機として相手に積極的な加害を行おうとする意思があれば、正当防衛にもなりませんが、やる気でやったと証言(自白)してしまいそうですよね、その同僚の先生。

電話を執拗に掛け続けるだけでも犯罪になることは、最近の報道でも明らかでしょう。
程度問題です。
水掛け論にならないよう、録音等客観的証拠を残すことが、やはり必要です。

暴行をほのめかして、「診察料は払わんぞ！」などと宣言する奴は、脅迫から1ハン・アップして未遂でも刑罰の対象になる可能性があります。

暴力には、できるだけ知性で対抗いたしましょう。

そうですよねー。暴力で向かってくる相手に仕返しのつもりで暴力ふるったら医師の方が失う物が多いですからねぇ。中学高校生じゃないですから、録音、写真、診断書添えて弁護士同席で告訴する方が数段勝ると思います。

私も、「毎日新聞記者は全て診療拒否すべきだ」とか「法曹関係者は全て診療拒否して医者のありがたさを思い知らせろ」とかいう主張を未だに目にしますので・・・お気持ちは察しますが・・・。

ただ、大野事件に対する捜査機関の総括が医師の耳に届いていない事は事実ですし、それが医師の捜査機関全体に対する不信感の一因になっている事も事実だと思います。

先生の、一部の医師に対するわだかまりも、過去ログをざっと見てあらかた理解は出来ますが、同時に、医師達の検察・警察に対するわだかまりも御理解いただけると幸いです。

がいい案だと思います。すなわち、公的な場所で、大野事件は冤罪だったと責任ある立場の人がお認めになれば、我々はかなり納得すると思います。
その上で、ではどうしてそのような冤罪が生まれてしまったのか、医療側には改善点が無いのかどうか、捜査当局では何が問題だったのか。そういう分析が目に見える形で行われていけば、救急や産科など、危険地帯で踏みとどまっている人たちにはかなり安心感を与えると思います。

大野の件については、この上なく責任ある立場である、警察や検察のトップが反省と今後の慎重な対応を公式に表明していたと思いますが、それでは足りないのでしょうか。
検察の立場としては、控訴せず無罪が確定させたことが実質的な敗北宣言になるのでしょう。検察官が「悪意を持って」故意に罪をでっちあげようとしたのでもない限り、あなたが言われるほど踏み込んだ謝罪の類は難しいのではないでしょうか。

司法側にせよ医療側にせよ、再発防止のための行動が必要なことには異論はありません。ただ、「とりあえず指詰めて持って来いや、話はそれからじゃ」というだけでは、なかなか前向きな流れに持っていきにくいのではないかとも思います。
少なくとも、あれ以降の検察が無理筋の起訴に慎重になっていることは傍目にも分かります。検察も「喉もと過ぎれば・・・」にしない努力はしているのでしょう。まずは検察のお手並みを注視しながら、医療の側も監察医問題などの改善策を提示していくのが建設的ではないでしょうか。
