人工心肺担当医、二審も無罪　東京女子医大女児死亡事故

被告である佐藤先生御自身のブログです。
当事者御本人のブログですから、そういう意味ではバイアスがかかっていると思われても仕方が無いと思いますが・・・。

この件はたしか事故後のカルテ改ざんが伴っていたんですよね。
医療側から見ると、あの改ざんにも同情の余地があったのでしょうか。

　この裁判は人工心肺を操作していた医師に対する業務上過失致死被疑事件ですので，被告医師は証拠隠滅等には問われていません。
　カルテ改ざんについては別の医師の有罪が確定しています。

　本日，東京高裁に行ってました。

　こちらの業務上過失致死被疑事件の被告医師はカルテ改ざんの巻き添えをくわされてしまったフシがあります。
　事件発覚の直後からワッチしてますが，使われていた人工心肺の構造が複雑で，これは「人工心肺の欠陥ではないのか？」と思っていましたので，予想通りの結果です。

　というわけで，これで，著名な刑事医療過誤訴訟は検察の連敗でして（大野病院，杏林割り箸，女子医大心研），もはや検察は，塩化カリウムをワンショットしたとか，人工呼吸器のスイッチを入れ忘れたというような単純な事故ならいざしらず，事故の検証に専門的な知識が必要な複雑な医療事故を捜査する能力がないことがはっきりとしたわけです。
　
　それどころか……，いろいろ調べていると，最近略式処分すら余り行われなくなっていますから，実は，検察は彼らのプライド上口が裂けても言えないでしょうが，刑事医療過誤事件に対して「萎縮捜査」「萎縮起訴」状態に陥っているようです。

一審の判決文を探したのですが、裁判所のページにはないみたいですね。

この事件、別の医師によるカルテ改竄があった以外は、大野病院事件ととても構図がよく似ているように思います。
病院側の出した事故報告書が過ちの始まりであった、というところが特に。

　カルテ改ざんは上司の教授の指示であり組織犯罪です。この事例の冤罪事件もインチキ事故報告書を出した大学とそれを鵜呑みにした能なし検察によるでっち上げです。本当は１審で確定でした。無罪が当然です。
　でも、遺族にとっては本当の責任者はうやむやにされて怒りのやり場がないでしょう。お気の毒としか言いようがありません。
　
今回も明らかになりましたが

事故の検証に専門的な知識が必要な複雑な医療事故を捜査する能力がない

個人的には今井先生はそんなかたじゃないって気がするんですが。
どうなんでしょうね？
カルテ改竄を見て見ぬ振りしたってくらいならもしかしたらって思わなくもないのですが、書き変えろって指示するとは思えないんですが。

　　　ご指摘のとおり、改竄は、ありました。証拠隠滅罪で、有罪確定しています。そのことに関しては、弁解の余地は全くないと言ってよいでしょう。国民/患者の皆さんにとっては、その問題の印象があまりにも悪いため、この医療事故で無罪になる医師がいることが納得できないのも無理からぬことです。

　　このあたりが、医療事故裁判の難しいところだと思います。患者さんが亡くなったのは、人工心肺の欠陥が原因だったのです。ですから、医師に罪はありません。なのに、とにかく事故自体をもみ消そうとしたのです。原因をきちんと究明しようという姿勢を示さず、隠蔽した、その姿勢、それを許した大学病院という医療組織の文化の罪の大きさは、はかりしれません。医療不信を決定的にしてしまいました。

　　訴えられた医師が科学的証拠で無罪を主張しても、隠蔽事件と混同されて、どんなにかやりにくかったことでしょう。そのことには同情せざるを得ません。「みみみ」さんも、この点はご理解いただけますでしょうか。

　　その一方で、まだまだ「みみみ」さんのような厳しい受け取り方をする国民は多いと覚悟し、医療界は、今回の無罪は無罪として、別件の隠蔽事件についての猛省は持続していかなければなりません。重い十字架を背負ったようなものと自覚しております。決して、忘れてはならないと自戒いたします。二度と、隠蔽事件は起こしてはなりません。

有罪が確定した講師は教授の指示だと言っています。
今井先生は指示したことはないと言っていますが、「改ざんしろ」とは当たり前ですが、言わないわけですから、カルテの記載を何とかしろとか、記録を何とかしろとか示唆しただけかも知れません。でも、それって改ざんの教唆そのものであり、大学の医局を守るためとはいえ、その時代でもやりすぎであったことは明白です。元同業者としては許せません。

佐藤先生御自身のブログによると、改竄は講師の保身からの行動で今井先生は関与していないとの印象を受けますね。

今回の医師が改ざんに関与していないのなら、当然線引きして考えなければならないでしょうね。

それにしても、改ざんするまでもなく正面切って争ってしかるべき事例だったとは知りませんでした。その、やる必要などなかった改ざん行為が、遺族に修復しようのない不信感と憎悪を植えつけてしまったのでしょうね。更に、世に医療不信の種を撒いたことや、関与していない改ざんで心証を悪化させられた被告の医師の苦難を思えば、本当に罪深い行為だと思います。

刑事医療過誤事件に対して「萎縮捜査」「萎縮起訴」状態に陥っているようです。

医療過誤に関しては医療界が主体となって解決するべきだと思っているのはないでしょうか。あるべき姿だと思います。

医療界が医療過誤に対して当事者意識を発揮せず、組織的な対策を生み出せないのであれば、検察が再介入することになるとは思います。

ですので、医療界が医療過誤に対し、どのような対策を生み出すのか、私は期待しています。

今井先生は本当のことを言ってるって認めてもらえたんだ。

きっと、どこかの新聞が紋切り型の陳腐なまとめ方をするだろうなと思ったら、朝日新聞がやらかした。

「医療過誤事件の真相解明の難しさが浮き彫りになった」
今回の裁判で真相はかなり解明されていると思うのですが・・・。
毎日ではなく朝日新聞にしても「真相解明＝有罪」なのでしょうか。

この見出しでは、「医療ミスの存在」が暗黙の前提になってしまいます。

なぜ、新聞社は、一般大衆に誤解されないように
「ミスは無かった」と素直にかけないのでしょうか？

産経最悪ですね。誤操作はなかったという結論なのにこの悪意に満ちた見出しです。名誉毀損ですね。

　医療ミスはあったけど、被告人の責任ではなかったということなんでしょうかね。　　
　たしかにＡＳＤの手術ぐらいで死ぬようでは、大学側の凡ミスであることは当然です。ただしこの事故は、システムエラーの要因が大きかったことが明らかですから、個人を断罪する刑事裁判としては、最低最悪の事案でした。

　チーム医療のシステムミスはあったから、ミスはなかったと断言するのは誤報でしょう。本件起訴も医師による医療事故調査報告書に基づいたものですから、その点をマスコミが言及しない方がどうかという気がします。

No.21 なんちゃって救急医 さんが問題にされているのは、無罪判決にもかかわらず、「業過で起訴された医師の医療ミスはなかった」、ということを報じないで、むしろ、「起訴された医師に医療ミスがあったのに、証拠上のハードルのせいで立証しきれなかった」かのように印象操作する報道側の姿勢だと思います。

文脈上、本件事故について「誰にも、あるいはチームとしても、医療ミスがなかったと報じるべきだった」という主張はどなたもしていないと思いますが。

Hands down, Apple's app store wins by a mile. It's a huge selection of all sorts of apps vs a rather sad selection of a handful for Zune.
