病院勤務医です。（今は留学中です)

当該病院で働いていた看護師が問題を起こして、病院として謝罪もない（もちろん金銭は含みません)のは不思議な感じがしますね。なにか特殊な事情があったのか？それとも、この原告のいう謝罪（＝お金）という意図がそもそもあり、病院側がそれに応えられなかったのか?

最近の刑事と民事を両方起こす事が時々あるようですね。被害者は例え被告が実刑判決を受けても、自分には何の得にもならないから、民事でしっかり得をとる(損害賠償）と言う考え方なんでしょうか。
　気持ちは分からんでもないですが、、、

痴漢などの場合、示談が成立する事がありますが（実際はどうか知りませんが、、、)、実刑判決に上乗せして、民事でも、という考え方には疑問を感じます。最初から示談という道はなかったのか?

病院でそんな破廉恥な事をする看護師は断固として許せませんが、このような犯罪（命にかかわらない犯罪)の場合、被害者には刑事と民事両方を許すのは圧倒的に被害者有利のような気がするのですが、いかがでしょうか。
（この事件の場合、病院を訴えていますので、病院の管理責任を問うているのでしょうから、ニュアンスは異なると思いますが、、)

示談という道を探るのはどの段階なんでしょう。（警察で取調べを受けている段階?　書類送検されてしまっても、その道を探る事はできる?）

それから量刑に関してですが、痴漢（例えば電車の中など)はこの男性看護師のように実刑判決（１年６ヶ月が相当?)なのでしょうか。

少し前に福岡高等裁判所宮崎支部の裁判官の方がちかん容疑をかけられていたのを思い出しました。

みなさま、いかがお考えでしょうか。

どうもよくわからないのですが,職務中であったとはいえ,職務と関連した犯罪ではなく,あくまで看護師個人が行った犯罪ではないでしょうか。看護師が強制わいせつを行うかもしれないという予見義務も病院にはないと思います。病院に損害賠償を求めるのはどうなんでしょうかね。
たとえば,一般の会社員が,職務中に職務と関係ない犯罪を起こした場合,たとえば外出中に些細なことから喧嘩をして相手を殺してしまった場合,会社が損害賠償しなければいけない責任は発生するものなのでしょうか。
また病院は精神的ケアーを行わずに退院させたというけれども,患者さんは病院にそれを求めていたのでしょうか。そうでなければ診療契約も成立していなかったと思うのですが。

　民法７１５条とその確定した判例があります。
　労働法では職務外の非行でも会社に損害賠償責任が生じる場合もございます。不法行為責任は契約責任と別個独立に生じます。
　もちろん、診療受付前（医療契約未成立）に病院廊下で医療従事者が受診しようとした被害者に不法行為（犯罪とか）に及んだ場合は、病院管理者側（施設管理者）に善管注意義務違反の不法行為責任も生じる場合もございます。

そうですね。ドライバーが保険に入っておらず、壊れた家を補償してもらえないときは、民事に訴えざるを得ない心境になるだろうと思います。しかし、保険できちんと補償された場合は、訴訟感情は沸いてこないかもしれません。

　ただ、とても大切にしていた思い出の品が壊されたとしたら、話は別、と言う事になるかもしれません。
このような事件の場合、そういう心の傷に対する補償、ということでしょうか。

刑事事件では加害者に社会的制裁を与える事が目的だと思いますが、それだけでは腹の虫が納まらない被害者が改めて民事で金銭を要求する。当然の権利とは言え、事件を事故、不可避な出来事（病院で患者が死亡するなど)をお金に換金する。今の日本では、このような考え方が定着しつつあるような気がします。

　就職の際に履歴書を出しますが、その経歴書に賞罰を書く慣行は、その名残りだと思います。ここら辺は、経歴詐称（賞罰偽装）と懲戒の効力として、長らく労働法で論じられてきています。答えは二者択一ではなく、場合分けがなされて判例法が集積されていますので、よかったらご参考にされてください。

今の日本というか、昔の日本でもそうでしょ。でなければ、我が国に自動車保険などといった制度が定着する訳がない。

そもそも、本件のような故意の犯罪とこぶこぶ様の仰る不可避の出来事とは、全く別物でしょう。それを一緒くたに考えているから、違和感が出てくるのでは？

犯罪被害を金に換金したい訳じゃないけど、犯罪被害を受ける前に戻して欲しいという願いが叶えられないから、次善の策としてその賠償を求めているだけでしょう。

こぶこぶ様ご自身が、保険で賠償されなければ民事に訴えざるを得ない気持ちになると仰ってるように、理不尽な被害を受けた者がその被害の賠償を求めることは、ごく自然なことであり、決して時代の空気などではないと思います。
