新館の伝言板に、勤務医です。 さんから以下のような投稿がありました。
爪のケアで爪はがし とされたという九州の病院での元看護師さんが 有罪になったという報道がありました。はたして 正当なケアが曲解されて 有罪になって良いのか。
日本看護協会は かつて この事例で公式見解をだしています。

産婦人科医が逮捕されたが無罪になった事例と比較し、この事例の報道内容は かなり間違っているようです。
報道としては、以下のようなものがあります。
「爪はぎ」元看護課長有罪...福岡地裁支部判決
田口直樹裁判長は「痛みを避けるなど患者への配慮をせずに切った結果、出血という傷害を生じさせた。ケアでも看護行為でもなく、正当業務行為に該当しない」として、上田被告に懲役６月、執行猶予３年（求刑・懲役１０月）の有罪を言い渡した。無罪を主張していた被告側は控訴する方針。判決によると、上田被告は２００７年６月１１日、当時８９歳の女性患者の右足親指の爪を爪切り用具で４分の３から３分の２切った。同１５日には当時７０歳の女性患者の右足中指の爪をばんそうこうごとつまんで取り去り、右足親指の爪を爪切り用具で８割方切り、いずれも出血させた。
田口裁判長は「出血が認められ、傷害に該当するのは明らか。看護行為ではなく、故意による傷害行為」と認定し、「ケアであることを忘れ、患者に無用の痛みと出血を伴わせた」などと正当業務行為に当たらないと判断した。動機については「爪切り行為自体に楽しみを覚え、目的としていた」と述べた。
正当なケアかどうかについては、皮膚科の先生の見解を重視したのかも知れません。専門家が以下のように発言している以上、裁判官としてはその見解を重く見るのではないでしょうか。
もっとも、大野病院事件で学んだように、皮膚科といえど爪のケアに詳しくない場合が考えられますね。

報道記事を丹念に読まれたのか、気になります。
この一審判決（asahi.com）では、
「判決は、患者のつめを深く切って出血させたとしても、看護目的であれば傷害にはあたらないと指摘」
したうえで、
「被告は患者のつめを切る行為に熱中し、その行為を楽しんでいた」
「自由に体を動かせない患者に無用の痛みを負わせ、家族や上司から説明を求められてもうそをつき続けた」
という事実が認定されているのですが。
即日控訴されたということですから、控訴審の判断も待つことにはなりますが、事実関係を置き去りにしたままでの「医療に司法が立ち入るのは不当！」というプロパガンダには、私は説得力を感じません。
控訴が為されるという事ですし、私自身が今回の事案について十分な情報を得ている訳ではありませんが、今回の裁判結果を論じるには、以下の１と２の切り分けは必要だろうと思います。
１，一般論として、「今回の手法による爪のケアという行為そのもの」は、ケアとして妥当であり適切に行われるとすれば刑事罰の対象とならない。が、しかし、個別事案としての今回の事案については、刑事罰が妥当する逸脱があった。
２，一般論として、「今回の手法による爪のケアという行為そのもの」が、刑事罰相当と判断された。
なお、当該の「爪のケア」の必要性や手法・必然的に付随する出血などについては、看護職目線で詳しく報道された番組を拝見した事があります。故に、一般論として当該手法による爪のケアの必要性・有用性については、個人としては認識しているつもりです。
これは証拠もなしに認定できる話ではありません。
こんなことを証拠なしに認定したとしたらそれだけで控訴審で判決が破棄されると思います。
ただし、証拠があったとしてもその評価を誤っていたとしたら結論は同じですけど。
で、どんな証拠があるかを想像しますと、被告人の内心の事情ですので、自供があれば自供に基づいて認定したと思われます。
自供がない場合は、事件当時の被告人の言動から推認することになると思われますが、このようなかなり異常な内心の事実を推認するためには、かなり異常な客観的な言動の存在が証明されていなければならないと思います。

昨年からこの「爪はがし事件」について他の常連さんと、共に意見交換をしておりました。
私も、勤務医です。さんも、他の参加者の方も、マスコミからの情報や、看護協会からの見解などを根拠に、訴えられた元看護師さんの行った行為は、患者さんのために行なったフットケアである、という意見でした。

といった意見は皆持っておりませんでしたし、ただただ、この有罪判決に驚愕しているといった感じなのです。
これは私の勝手な想像でしかないのですが、
けして、勤務医です。さんはプロバガンダ目的で文章を書いたのではないと思うのです。
この判決を、有罪判決を聞いたとき、もう、呆然といたしました。

などから、彼女の行った行為は虐待ではないと考え、よい結果、無罪が判決としてでますように！
と願っておりました。
いずれもマスコミからの情報でそれを頼るしかありませんでした。
しかし、
昨日の判決報道から、今まで伝わってこなかった、知りえなかった、
＞判決は「上司に問われても関与をしていないとうそをつき続＞けた」（田口直樹裁判長）と断じた。

等ががあがっており、さらにそれが事実として認定されてしまったことに愕然としております。
被告は公判で一貫して「看護師の信念に基づいてつめのケアをした」と主張していたのですが、弁護側の主張は何故退けられてしまったのか、
また、 fuka_fuka さん が紹介して下さった朝日新聞の記事では
＞判決は「職場内では患者のためのケアとは理解されていない行為だった」と退けた。
とあったのですが、上記で紹介したザ・スクープでは、
元看護師さんの移動前の元いた、病棟では彼女の行なうフットケアは受け入れられ、普通に施行されていた・・という情報があったのです。
その彼女を信頼していた元の病棟の人たちは弁護側の証人にはなりえなかったのでしょうか。
彼女を刑事告発したのは、所属していた病院ですから
同じ病院内で、こちらの病棟では検察側の証人、あちらの病棟からは弁護側の証人・・ということは無理なことだったのでしょうか・・・。
いずれにしても・・事実認定という、思い事実を冷静に受け止めて、またこの問題を見つめなおしていかなければ・・と思っております。

なるほど。勤務医です。さんにとっては「正当なケア」と信じる背景があったのですね。
プロパガンダうんぬんの点は行きすぎの表現でした。勤務医です。さんにもお詫び申し上げます。
ただ、No.6 でモトケン先生が説明されているとおり、刑事事件で裁判所が認定する事実関係は、必ず証拠に基づいています。
そのため、まず判決の報道を目にした側としては、別の根拠が示されないで判決を不当とする批判がされても、「事実の無視」としか映らなかったという点はご理解いただければと思います。
報道が人間の主観を経由するものである以上、すべてバイアスがかかることにはなりますが、「ザ・スクープ」は特にその傾向が強いといえると思います。（この件の放映は見ておりませんが）
この一審判決を前提にみた場合、「患者家族や上司に嘘をつき続けた」といった、この（元）看護師にとっての不利益な情報は、「正当なケアへの不当起訴！」という文脈に沿わないものとして切り取られた可能性が高いのではないかと。
私見ですが、このような、家族や上司への嘘という行動を裏付ける証拠があったのであれば、「正当な看護」「必要かつ妥当なフットケア」という主張を否定する要素として裁判所が重視したことは想像に難くないと思います。
総合評価の一事情ですので、それだけで決定的とまではいえないと思いますが。
があるのであれば、そのような異動前の病棟の関係者が証言をすることに手続上の制約はありません。
地裁でそのような証人尋問が行われたうえで否定されたのかどうか分かりませんが。
いずれにしても、控訴審では弁護側立証が成功し、無罪になる可能性も十分ありうるところだろうと思います。
私も、この（元）看護師に対して、「有罪当然！」という見方をしているわけでは全くありませんので、念のため付言します。
第３者が不適切と考える医療行為を刑事犯に問うことはこの事例でも分かるとおり外形的にはすぐに出来ます。この場合、本人がケアであると言っても、傷害という外形的事実が残るので、被告人側には非常に不利です。元の病棟と、告発した病棟とどっちが正しいか分かりませんが、有罪確定の場合は当然に出血させないように萎縮ケアが進行することだけは必定です。
それが良いことなのかどうかは後の人が判断するでしょう。怪我させてはイケナイというのが今の世の中の流れです。観血的治療は原則として避けるべきという時代になるのでしょう。小生は萎縮やむなしと思っています。

実は、この事件は当初報道された時、また患者さんへの虐待事件がおこったのか・・
と私の周囲では思われていました。
「また」と言うのは、この事件の少し前に京都でのつめはぎ事件があり、有罪判決が出ていたからです。
しかし、その後の検証番組や看護協会の見解などから
「ああ、しまった。患者さんの為に熱心にフットケアをしていた同じ職業の人を、虐待をしていたなどと誤った見方をしてしまった。彼女に失礼だった。」と、
自分の誤った見解を恥じ入りる様な気持でした。
それは私の周囲の看護系の友人達も同様な反応でしたし、参加しているＨＰでも同様の意見が聞かれていました。
そのような思い入れが、みな強くあったために、判決報道を
最初聞いた時、冷静に受け止めきれていなかった・・と思います。

というように証言がぶつかっており。
しかし、事実認定されてしまった「彼女が嘘をつき続けた」ということがやはり上記の異なる見解を選ぶ上で、大きく心象を悪くし、有罪を確定づける要因となってしまったのでしょうか
・・・。
それがどのような状況だったのか、嘘とはなんなのか、嘘をついたと彼女は認めてしまったのか、また、今までその情報はなぜでなかったのか・・。
疑問に思うことはたくさんあります。
いまはまだ、少ない情報から、悶々と考えるしかないのですが・・。
いずれも、頭を冷やして、フラットな目線でこの事件をみつめて行きたいと思っております。
こういう事件の場合は、萎縮効果を最小限にとどめるためには、なぜ有罪なのかという理由を一般にわかりやすい形で説明する必要があると思います。
誰が説明するかですが、第一次的には裁判所の判決がそのソースになります。
まず裁判所がわかりやすい判決を書く必要があります。
しかし、判決は法廷で朗読されるだけですので、一般市民に周知させるのはマスコミの機能ということになります。
ところが、マスコミは判決のポイントを的確に把握できるとは限りません。
ポイントを把握できずにわかりやすい説明などできません。
となると、弁護士ブログのような専門家ブログが判決に基づいて補完説明することが期待されると思うのですが、往々にして判決を読んでも肝心な証拠関係が分からない場合があります。
裁判所には、せめて専門家が読めばポイントがわかる判決を書いてもらいたいと思います。
そして、判決だけでも速やかに一般に周知させるルートが確立してほしいものです。
もっとも、判決がトンデモの場合は、萎縮効果が最大限に発揮されることになりかねませんが。

もれ伝え聞いています。
もちろん・・虐待であるなら・・それは正されなければいけないことです。が、
また別の側面から「萎縮ケア」を招く要因をつくることになるのか・・・と思うと、

裁判員制度より先に、ネットで簡単に判決文にアクセスできるシステムをもっと本格的に運用してほしいと私は思います。

患者さんとの検温時や、お部屋を訪れていろんな情報収集する時に色々と趣味のお話など聞かせていただくとき、話が弾んで会話を楽しむ時はありますが、
「処置を楽しむ」ということは、芳しくないと思うのですが・・。
患者さんは、どんな小さな処置でも緊張されるものですし、
ましてや、痛みを伴うものであったら、医療者は処置を「楽しんで」はいけないのでは・・と思うのです。

何も出来ない状態ですし・・この事件の起きた市内の医療には
私も、何の責任も負えません。

やっぱり、そんなことなんてわかっていないのですね。

報道によれば、裁判官がそう認定しているんです。
法律家がそういう報道を読んだ場合、裁判官が証拠に基づいてそのように認定した、と考えるわけです。
証拠の具体的内容がわからなくても、裁判官がそういう認定をしたということは、そのような認定の根拠となる何らかの証拠が存在するのだろうと推定するわけです。
まず、自分は司法システムについて理解していないところがある、とお考えいただきたいと思います。

私の高齢の親も巻き爪の為、皮膚科の塗り薬（飲む薬は他の病気の薬との兼ね合いで飲めない為）と定期的な爪切りをしています。素人の私が親の爪を切っていますが、出血したことは一度もありません。よく行く皮膚科でも爪をきってくれますが、一度も出血する事はありませんでした。出血するほど切る必要がどこにあったのかわかりません。プロである看護師の判断がこのようなら、怖くて親を病院に入院させられません。これは、爪のケアでしょうか？大変、疑問に思います。

爪が白癬菌（爪水虫）等で肥厚し、爪きりがしにくかったとは思いますが、出血した時点で、それは爪ではありません。
爪なら切っても出血しませんが、周囲の皮膚、又は深く切ったから、出血したのです。
この時点で、適切な爪きりではありません。
なぜなら、周囲の皮膚を切ったことで、そこからばい菌が入り、感染症を起こすことがある、また、皮膚には神経が通っていますから、患者は苦痛を感じたことと思います。
片方の爪に、意図的にでなくしてしまったならわかりますが、それでもこれが正当なケアとは言えない筈。
誤って出血させてしまった、それならもう片方も同じ深さに切らない筈です。
一回深く切れば、長い間爪が生えてこないので、介護に手がかからないと思ったのか、その行為を楽しんでいたのか、理由はわかりませんが、皮膚科医の立場から、正当な爪きり行為ではないのは明らかです。
他の皮膚科医の意見を集めてみれば判る筈です。

患者、又は患者の家族が病院を訴える。
病院側は患者に対して責任があり、その病院内で起こった全ての事に管理責任者としての責任があります。
で患者対病院では、病院が患者に責任を負う、ただ、その先で、病院が、従業員を訴えられないかというとそれは訴えられます。
適切な職務を遂行しなかった場合、病院は従業員に責任を求められるのです。
