医薬品ネット販売の議論の現状

先刻、ドラッグストアで目薬を購入しました（花粉症対策）
最近薬局での一般販売が許可されたいわゆるスイッチOTCの抗アレルギー目薬です。
ドラッグストアの棚にずらっと並べて売っており、私は直接手で取り、レジで購入しました。店員には全く何も聞かれませんでした。
対面販売といいつつ実態はこんなものなのに、ネット通販だけを狙い撃ちにしたような規制は不当なものだと思います。

　消費者、つまり国民は何を求めているのか―。

　自分としてはネットで薬品を買ったことが無く、ネットで買う必要に迫られたこともないので、規制が行き過ぎかどうかは一般論でしか考えていません。こんな私は国民ではありますがこの場合の消費者に入るのでしょうか。

　消費者からヒアリングを行う場合、ヒアリングの対象となる消費者とは何を指すのだろうか。国民から無作為に選ぶのか、それとも実際にネットで薬品を購入している人の中から選ぶのか。このどちらであるかによって、結果は大きく異なるのではないでしょうか。

　でも、ネット購入したことが無い人を集めてヒアリングしても、意味がないような気がします。
「規制されても私は困らない」
という意見が多いから規制しても問題ない、ということにはなりませんから。そう考えると国民から無作為に選んでもあまり役には立たない可能性が高い。

　となると、ネットで薬品を購入したことがある人の中から選出しつつ、偏りのない立場の方ということで、規制反対派や規制賛成派の組織に属している人を除く、と…。
うわぁ人選が難しそう。

ネット販売が危険で対面販売が安全という根拠が小生には信じられません。販売経路による危険性の上昇の根拠は少々科学的でないと思われます。

医師法でも対面診療は求めていないのに、監査では注意されていました。
昔の事故で書類を書いてくれと言われ、主治医がいないことなんてよくあるし、時間がないので薬だけ欲しいという患者もいるからです。
対面診療が問題になったのは、遠隔診療を普及させようとしたときです。
僻地や緊急時に中核病院で画像診断をしてもらったり、病理診断をするためです。
無診察診療の禁止（医師法第20条）に対し健政発第1075　97年12月24日　厚生省健康政策局都道府県知事通知が出されました。
遠隔診療の基本的考え方と留意事項
診療は直接対面しておこなうことが基本ですが、医師法第20条における診察とは現代医学から見て一応の診断を下し得る程度のものをいう。
ネット通販でもこの辺が落としどころかと思います。
現代医学から見て一応の安全を得られる程度の監査をすること。

ネットでの薬の売買で、薬害や中毒死が起きた場合、世論やマスメディアが厚労省を批判しないのであれば、厚労省はこの種の規制を行うべきではないでしょう。

一方、薬害や中毒死が起きた場合、厚労省が少しでも叩かれる可能性があるのであれば、厚労省は積極的に規制を行ってもいいと思います。

薬害・中毒死において、厚労省が責任を取るのか、薬の販売業者と消費者が責任を取るのか、そこが問題になってくると思います。薬の販売業者が被害者救済に全責任を負うのであれば、厚労省はネット販売を認めるべきでしょうね。
