司法全般に対する無理解が感じられますので、新館でも取り上げるかも知れませんが。
アメリカでは医療過誤訴訟ひとつで病院がつぶれるので、訴訟を避けるためにありとあらゆる検査や治療を行なう「防衛医療」が異常に発達し、医療費が世界最高になっている。それでも訴訟リスクが避けられない場合には、患者を拒否する。同じことが日本でも起こりつつある。問題は産婦人科医の不足ではなく、手術の失敗に刑事罰を科すなど、人命のためには他のすべてを犠牲にする司法のバイアスである。それは結果的には、多くの人命を失う結果をもたらしている。
同じブログで「レセプトオンライン請求によって不正請求がなくなる」なんてことも言ってましたね。いいことも書いているんですが、ちょっと思い込みの激しい方のようで、時々アレな記述が見受けられます。
ジャーナリスト上がりの経済学者とすればこんな物ではないかしら。

これは、司法のバイアスというよりも、立法の法整備の問題のように思います。
それから、司法においてトレードオフを行うのは裁判官であって、検事、弁護士ではないと思うんですけどね。

米国の医療についての、事実確認の不足が明らかです。
よって、意味の無い文章だと私は思います。
日本の現状についての認識もずれているようですからね。

刑法に「許された危険」という概念がある。団藤刑法綱要にも載っている。
本来は法益侵害の危険が高く違法だが社会的効用の見地から違法性が解除されているもの。
典型例は、一時は年間１万人（最近でも年間５千～３千人）が事故死した自動車交通。

ハスカップさんの引用ですが、私も昔、高校生くらいのころに同じこと（自動車の全面規制）を考えてました。
ただ、自動車によって救われている命もあるわけです。直接的には救急車や消防車なんかがそうです。仮にこれらも規制された場合の（本来なら助かったはずの）死者数と比較しないと何とも言えないと思います。どのくらいかは調べないと分からないですが、消防車がないと火事で相当亡くなっているでしょうね。

調査不足無知無理解で攻撃するのは、どんな道の専門家でも門外漢の誤謬で５秒で御仕舞。それは弁護士に限らず、経済学者でも公務員でも政治家でも同じ。

おそらく元々Defensive Medicineと言う言葉は医療訴訟を恐れるあまりに過剰な検査や処置を行うことを指していたと思います。
日本ではそれと反対に、本当なら（医学的にというか確率的に）しておく方が良い治療をしない意味で使われることが多いようです。
アメリカでも両方あるようです。
