東京平河法律事務所に所属されている小倉秀夫弁護士のため息の出るようなエントリです。
「中世の魔女裁判のような拷問を加えたりしなくとも被疑者は虚偽自白するし，そのことを完全に防止する術はどんな優秀な弁護人にもない」（ウェブ魚拓）
小倉弁護士は、自分の書いたエントリ「25日までに！？」とその反論のエントリ「大久保被告人の弁護人は無能だと言いたいのでしょうか？」の内容を理解しているのでしょうか？
小倉弁護士は、「25日までに！？」で、大久保被告人の自白が起訴日（３月２４日）の翌日（２５日）になされたものであるということを前提としています。
しかし、産経の記事によれば、大久保被告人は
勾（こう）留（りゆう）期限が迫った最近になって、「献金が西松からだと認識していた」と供述したという。
つまり、勾留期限前に事実を認める供述をしていることになります。
そして、この産経の言う「供述」と小倉弁護士が引用した日刊スポーツのいう
２５日までに、同社から違法な企業献金を受領しながら虚偽の報告をしていたなどとする政治資金規正法違反罪での起訴内容を大筋で認めた。
という供述が同じものであるならば（ニュースソースがいくつもあるとは思えませんので同じである蓋然性が極めて高いと見るのが自然でしょう）、それだけで小倉弁護士の「25日までに！？」は的外れになる、というのが私の反論エントリの前半部分です。
はっきり言って、自白の経緯に関する議論はこの前半部分で終わりです。
これに反論するのであるならば、「いや、日刊スポーツの言う自白は起訴後の２５日なんだ。」ということを論証する反論を行わなければいけません。
その点について、小倉弁護士は、
なお，矢部教授は，スポニチの記事において「２５日まで」となっていて「２５日に」となっていない点を過大視しているようですが，２４日の時点で大久保容疑者の自白調書が作成されており，２５日以降は取調べ等が行われていないのであれば，起訴の際の記者会見でその旨の説明があるのではないか（２５日以降にリークする意味って何なの？）という気がしないわけではありません。
というだけで、積極的な論証はなにもできていません。
なお、事件報道で、過去の捜査経過について「警視庁は、○○日までに容疑者数名を逮捕した。」というような報道の仕方をしばしばします。
これは、記者が情報を得たのが○○日ということで、逮捕日は明確でない場合や記述を省略する場合の書き方であって、決して○○日に逮捕したという意味ではありません。そして、そのような説明はなされません。説明しなくてもわかることだからです。
小倉弁護士は、「２４日の時点で大久保容疑者の自白調書が作成されており，２５日以降は取調べ等が行われていないのであれば，起訴の際の記者会見でその旨の説明があるのではないか」と書いていますが、産経の記事ではちゃんとそう書いてあります。小倉弁護士はどうしても産経の記事はないものとしたいようですが、目をつぶったとしても産経の記事がなかったことにはなりません。
以上のように、私の反論エントリの前半では、大久保被告人の自白は起訴前になされた蓋然性が高いと指摘しているわけですが、小倉弁護士の「25日までに！？」が的外れであることを示すためにはそれで十分ですので、起訴前の自白がどのようにして得られたかについては全く言及していません。
私が、自白の経緯について触れたのは、あくまでも起訴日（２４日）から２５日までの長くても３０数時間（取り調べ時間とすればせいぜい１０数時間、仮に取り調べがあったとしてもですよ）程度の間のことです。
しかも、大久保被告人は強力な弁護団の弁護を受けています。
私は、このような大久保被告人に特有の状況を前提にして意見を述べています。
しかし、小倉弁護士は、そんなことは一切捨象して一般論を展開するだけです。
しかし，どんなに優秀な弁護団が就いていたとしても，わが国では取調べへの弁護人の立ち会いが認められていませんし，接見だって四六時中やっているわけにもいきません。被疑者を孤立させたり絶望させたりすることにより，「中世の魔女裁判のような拷問を加えたり」しなくとも被疑者が虚偽内容の自白をしばしばしてしまうことは様々な研究結果等により既に明らかになっている
この部分です。
一般論としては、代用監獄で２０日間以上身柄を拘束され、弁護士の援助もなく、厳しい取り調べを受け続ければ虚偽自白をする場合があるということは事実として明らかにされており、私もそれを否定するつもりは一切ありません。
しかし、この一般論を今回の起訴後のそれも短時間の取り調べに適用して、虚偽自白の可能性が高いと言うのであれば、それはあまり説得力のある議論とは思えません。
小倉弁護士は、先ほど引用したように、
２５日以降は取調べ等が行われていないのであれば，起訴の際の記者会見でその旨の説明があるのではないか
と言っています。
ここまで想像力が働くのであれば、もし、大久保被告人が任意性に疑問が生じるような無理な取り調べを受けたというのであれば、自白の有無にかかわらず、弁護団は検察に対して強硬な抗議を行うことくらいは容易に想像できるだろうと思われます。
しかし、そのようは話は何もありませんね。
民主党も何も言いません。
ちなみに、刑事裁判において被告人の自白の任意性を争う場合に
わが国では取調べへの弁護人の立ち会いが認められていませんし，接見だって四六時中やっているわけにもいきません。被疑者を孤立させたり絶望させたりすることにより，「中世の魔女裁判のような拷問を加えたり」しなくとも被疑者が虚偽内容の自白をしばしばしてしまうことは様々な研究結果等により既に明らかになっている
などと主張しただけでは、何の意味もありません。
もっと具体的に、当該被告人の自白について任意性に疑いを生じさせる具体的な事情を主張する必要（立証までは必要ない）があります。
今のところ、大久保被告人についてそのような情報がありませんので、言及することができません。
一般論を語られても、「そうですね。」としか言えません。
小倉弁護士は私の個別の具体的状況を前提にした意見に対して、すぐに一般論で反論します。
つまり、一般論でしか反論できないわけです。
これは刑事事件の経験の差として如何ともし難いところだろうと思います。
私は、知財関係の問題では小倉弁護士を批判したことがありません。
それは小倉弁護士の知財関係の知識と経験を尊重しているからなんですけどね。
つか、批判しようにも私にはその能力がないということです（＾＾；
ところで、小倉弁護士は
勾留期限まで頑張れば厳しい取り調べから解放されると信じていたのに勾留期限後も同様の取り調べが続いたとなれば（この時点で，弁護人からの説明は実際上空理空論となってしまっているわけですから），被疑者としては検察官に迎合して検察官が要求するストーリーを是認するまでは厳しい取り調べが際限なく続くことが想定されるため，耐えられなくなって虚偽の自白に応じてしまうことは十分に考えられます。
と言っているわけですが、「（この時点で，弁護人からの説明は実際上空理空論となってしまっているわけですから）」というところが意味不明です。
小倉弁護士は、いったい弁護人が被告人にどのような説明をしていると考えているのでしょう？
お返事があれば意見を述べますけど、優秀な刑事弁護人はあらゆる場合を想定した助言を行っています（例えば、起訴後に取り調べを受けたらどうすればいいか、という場合についてもです。）
なお、前エントリでも述べていますが、本件で検察が起訴事実について起訴後に取り調べを行う必要があるとは考えられません。
またそんなことをすれば、弁護人に保釈請求のネタを与えるようなものですから、厳に避けると考えた方が合理的です。
もちろん，そのような取り調べによってなされた自白はさすがに任意性を欠くものとして調書が却下されることは十分に考えられるわけですが，検察の目的が次の総選挙で民主党を大勝させないことにあるとすれば，総選挙後に上記自白の任意性が覆されても，痛くもかゆくもないわけです。
これ、本気で書いているんでしょうかね？
検察にとって、検事調書の任意性が認められないことの重大性に対する認識がほんとにないんでしょうか？
法曹なら、ネタとしか読めない一文なんですけど。
私のエントリに対する反論のためなら、自分の無知をいくら晒してもいいということなんでしょうか？
こうなると理解不能です。
素人の方に簡単に説明しますと、検事調書の任意性を否定されるということは、検事に対する信頼が揺らぐということです。
そうすると、将来の別の事件の公判維持に重大な悪影響が生じます。
特捜部の最も強力な武器の攻撃力が大きく減殺されるということです。
このような深刻な不利益と民主党を大勝させない（？）ことを検察が天秤にかけるとでも思ってるんでしょうか、小倉弁護士は。
教科書的な理解しかないのであれば、そう思うのかも知れませんが。

最初の一文は、一般論しか書いてないじゃないか、という私の批判に対する反論のようです。
小倉弁護士によれば、一般論ではない批判というのは「実際に弁護人として自白調書の任意性を崩していくときと同じ濃度の論述」ということになるようです。
極論でもって反論した気になっているようです。
小倉弁護士は、報道に現れた程度の具体的事情からは何も言えないようですね。
だったら、最初からものを言わないほうがよいと思います。
「そこまでして何かを誤魔化したいのでしょうか」は何をか言わんやですね。
一般論でしか語れないことをごまかしたいという気持ちは十分に分かります。

こちらの報道のほうが信用できるということになれば、小倉弁護士の
もちろん，そのような取り調べによってなされた自白はさすがに任意性を欠くものとして調書が却下されることは十分に考えられるわけですが，検察の目的が次の総選挙で民主党を大勝させないことにあるとすれば，総選挙後に上記自白の任意性が覆されても，痛くもかゆくもないわけです。
は、まさしく妄想ということになりますね。
小倉弁護士は、日刊スポーツの報道にこだわってますけど、この時事通信の記事は、一つの記事だけで判断することの危険性については教えてくれていると思います。
小倉弁護士に教わる気があるかどうかは知りません。

一言一句慎重に検討された形跡が窺えます。

素直に

または

と言ってしまえばラクになるのに。
こういう「自分の非を認めてラクになる」という道を選ばない生き方は、苦悩が多そうです。
しかし、あらゆる点で、刑事事件の実務から乖離した空理空論を、これほど饒舌（饒指？）に語ることができるのも、一種の才能ですね。
「実務の常識からしたらおかしい」と読めそうな記事ならば、まず自分の誤読、次に記者の誤解を考えるのが普通だと思うのですが。
「実務上ありえない行為がなされた」と確信をもっていいのは、それ以外のあらゆる可能性を潰した後でしょう。
それをしないで、自分の意見を述べたら、自分が恥をかくだけなのに。

検事（刑事）の取調べによる自白＝虚偽自白の強制
という前提を持っておられるように見えますので、小倉弁護士が１０年ほど前まで刑事弁護士としてご活躍されていた頃は、被疑者被告人に対して「否認し続けていれば証拠がないから起訴されない」あるいは「否認していれば有罪にはならない」と説明されていたのではないでしょうか？
もちろん自白以外の客観的証拠が揃えられていても無視する方向で。

この手の陰謀論の最大の欠点は、陰謀を企図した（とされる）側は発覚の可能性を全く考えていない、あるいは陰謀が発覚した際のリスクを全く考慮に入れていない、と思いこんでいるところにあります。
陰謀でもなんでもない田舎警察のほんの数人の不心得者による違法行為である志布志事件が発覚しただけで、全国警察はその組織が存続し続ける限り影響し続けるであろう多大なダメージを受けてしまいました。
発覚のリスクがゼロには出来ない以上、組織としての根幹を揺るがすような陰謀は危険性が高すぎて検討にも値しない、と考えるのが常識的な思考だと思うのですが・・・

事実関係とそれを裏付ける証拠関係を慎重に吟味しないと、マスコミは大誤報をやらかしますし、どんなネット上の特殊専門家でも、引っ込みがつかない間違った独自の見解を開陳するハメとなります。もちろん自戒を込めた言葉です。
特に、ネット上で流布される情報のみで、「いいとこどり（クリームスキミング）」で印象操作攻撃をすると、待っているのは大抵「穴があったら入りたい」という心情に追い込まれます。

Hands down, Apple's app store wins by a mile. It's a huge selection of all sorts of apps vs a rather sad selection of a handful for Zune. Microsoft has plans, especially in the realm of games, but I'm not sure I'd want to bet on the future if this aspect is important to you. The iPod is a much better choice in that case.

The new Zune browser is surprisingly good, but not as good as the iPod's. It works well, but isn't as fast as Safari, and has a clunkier interface. If you occasionally plan on using the web browser that's not an issue, but if you're planning to browse the web alot from your PMP then the iPod's larger screen and better browser may be important.
