たぶん、１年目の弁護士会の研修（義務）としてやることになっている、国選・当番・法律相談（クレサラとか）の一環でやっただけなんじゃないでしょうか。
それ以降、自分の意思で担当した事件の経験があるような記述は、どこにも窺えません。
「（元）刑事弁護士」を自称すらしていないようにも思えますが。

モ　「秘書さんは酔っ払ってなかったはずです。状況が違えばトーンが違うのは当然です。酔っ払ってなくて通学途中の女子高生の前で全裸になったら逮捕でもいいと思います。状況の違いを無視する人とは議論になりません。

お　「↑酔っぱらっていると構成要件が変わるの？（＊２）」

＊１：　ブクマ対象のエントリ本文に、警職法も酒に酔つて公衆に迷惑をかける行為の防止等に関する法律も条文が引用されているというのに。ほんとに「トラ箱」の存在を知らないのでしょうか？弁護士が？

＊２：　ええと、逮捕の要件が構成要件該当性だけで決まるというお考えなのでしょうか。モトケン先生が「状況が違えば」と書いている意味がまったく理解できていない？個々の行為の悪質性を捨象した構成要件該当性だけで、どうやって「警察比例の原則」を判断すればよいと？

ほんとうに謎です。現役法曹のしたためる文章として。

　某私立大学法学部非常勤兼任講師の小倉秀夫弁護士（判検事の採用歴無し）は、「追記」という形で、やっとここの引用付きリンクを張ったみたいですね。さすがに今回は批判を無視したまま唯我独善とは行かなかったようです。

　刑事裁判実務と検察実務を経験していないと，合格至近レベルの司法試験受験生でも間違えないような現行犯逮捕要件と通常逮捕要件の異同を間違えるようですね。公然わいせつの構成要件該当性判断も間違っているようだし。やはり法律実務も経験則に基づかない空理空論は妥当性を欠くのでしょう。

最低限のマナーの話から勝ち負けの世界になってるとは...

このスレには全く関係の無い個人名（実名なのかどうか私は分かりませんが）のようなものを批判まじりに掲載するのは止めたほうがいいと思います。

　最初に○○○を投げつけたのはどっちかっていう話ですよ。
　というわけでこの話はこれでおしまい。

　ちなみに、山下幸夫弁護士は自他共に認める熱意と能力と経験を兼ね備えた優秀な刑事弁護士です。
　「自他共に」と言いましたけど、自分では口にされませんよ。謙虚な方ですから。
　「他」も認めるというのが大事なところです。

　感想くらいは聞いてみたいので質問しますが、ブログ主の方針に反するコメント（事実上ほとんどのコメント）を掲載しないブログとあなたのようなコメントも事前承認なしで掲載しているブログと、どっちが「小宇宙」だと思いますか、加藤さん？

コメント欄を（事実上）閉鎖しているブログと解放しているブログは性格が異なるので、何とも言い難いですね。オグリンの定義によると、オグリンのブログはそもそも対象外みたいですし。

なお、このブログがモトケンさん寄り・反オグリンの立場からのコメントの投稿場所となっており、これがオグリンのブログに頻繁にトラックバックされていますので、オグリンのブログのコメント欄に関する方針は、ここの住人の方々にはあまり関係ないのではないでしょうか。

それは無いと思います。
小倉先生の発言内容にそってその正当性を主張なさればスレ違いとは言われないと思います。
小倉先生の論敵のかたを小倉先生の意見と無関係に批判なさったり、このスレには全く関係の無い個人名（どうやら実名だったようですが.....)を持ち出したりすることがスレ違いなのだと思います。

このスレにそって小倉先生よりのコメントをするということは、リンクを貼らずに「逮捕と保護を比較して保護でもよかったんじゃないの」という人の意見を「警察官が「このままお楽しみ下さい。」と引き下がって交番に帰るべし」という意見にかえてその人の意見としてブログに書く事の妥当性について述べることかなと。

ただしそういうご意見についてはスレ違いとは言われないでしょうが賛成しかねるとのコメントが多くなると思いますが。
その場合はこの小宇宙ではオグリン寄りのコメントを投稿すると常連が多数で攻撃してくるとおっしゃるかもしれませんが、たぶんここを出て広い世界で同じ発言をなさっても反論かスルーがほとんどで賛成なさるかたはあまり多くないかと思います。（はっきり言えば小倉先生ご自身でも賛成なさるかびみょ〜かも。）

　加藤さんは、ハスカップさんのコメントの意味が理解できているのかな？

　参考として、このスレで「背中」でページ内検索してみるといいと思うよ。

此処で「オグリン寄りの意見」に皆が批判的なのは、オグリン当人が自己に批判的な意見を容認してこなかった事実に対しての批判ではないのかな。

ネットであろうと実社会であろうと、自身の意見や考え方を表明すれば、賛意と同意の意見だけでなく反論や非難の意見も飛んで来るのは致し方ない。賛同は受け容れるが反論には聞く耳持たない態度は、討論や議論の在り方としてフェアな態度なのだろうか。

此処では「オグリン寄りの意見」に批判的なのではなく、「オグリン的な討論の姿勢」に皆が批判的なのだと思う。

　相手が誰であれ、胡散臭い投稿は最初からスルーしているんですけどね。スルー放置無視され続けたのに、執拗に繰り返し同じネタで勝手に絡んできて逆恨みのような文句を言われても「困ってしまいますと言えそうです。」＞誰とはなく

　ブログ主の方針に反するコメント（事実上ほとんどのコメント）を掲載しないブログで、ほとんど本人一人しかいないのだから小宇宙は言えず、せいぜい小惑星レベルじゃないかと。

　ものすごく脱線しますが、「小宇宙」を見ると、ついつい「コスモ」と読んでしまう年代の私です。

実務感覚という点でいうと，草なぎさんの例の事件で，「自分が受任したら無罪主張していく」という弁護士の方がいかがなものかという気がします。

と思ったら、モトケン先生のご意見は

と、誤読の余地なく明確に「起訴後に受任した場合」を前提としたものであるのに、おぐらせんせいの批判は

前科前歴がなければおそらく起訴猶予であろうということが見込まれるときに，公判請求がなされるリスクを負ってまで「嫌疑無し」での不起訴を勝ち取る（ﾏﾏ）に行くというのは

というものですから、「なんだまたいつもの藁人形か」でした。

いったいどなたを批判したかったのでしょうね、おぐらせんせいは。
「私が今の段階（起訴猶予の報道前）で受任したら、嫌疑不十分の起訴猶予ではなく、嫌疑無しでの不起訴を勝ち取りに行く！」と公言されていた方というのは思い当たらないので、ご存知の方いらっしゃいましたらご教示ください。

なお、起訴猶予報道後のモトケン先生のコメントも、No.165 のとおりで、「嫌疑無しの不起訴を勝ち取りに行こうとしなかった弁護人の方針について賛意を示している」という、おぐらせんせいの批判とは正反対の方向性と読むのが普通の読解かと思います。
